In these Terms, the following definitions apply:
NOYU is operated by PROJECT 120 LTD, a company registered in England and Wales (company number 16584137) with registered office at 3rd Floor, 86-90 Paul Street, London, England, EC2A 4NE. You can contact us at hello@noyu.health.
By creating an account or using the Platform, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not access the Services. You must be at least 18 years old to use the Platform.
When you sign up, you also consent to us processing your Health Data to provide the Services, as described in our Privacy Policy. NOYU is available to Members in the United Kingdom and the European Economic Area.
NOYU is a health app that makes sense of your health data and tells you what to do next. Our Services include:
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time. We will notify you of material changes where reasonably possible.
To use the Services, you must:
You can delete your account and your data at any time from within the app.
You agree not to:
We may suspend or terminate accounts that breach these rules.
NOYU helps you understand your health data, but it is not a medical device and is not a substitute for professional medical advice, diagnosis, or treatment.
NOYU is free to use. The only paid service is an optional one-off blood test, which you can buy, or redeem using a Blood Test Credit. Prices are shown before purchase and are inclusive of VAT where applicable. Payments are processed securely by our payment provider Stripe - we never see or store your full card number. We do not currently offer paid subscriptions.
Some early Members bought a "Founding Member" subscription under our previous terms. NOYU is now free and no longer offers subscriptions, so we are converting each Founding Member's payment into a Blood Test Credit of equivalent value, which you can redeem with our testing partner. If you were a Founding Member and have any questions, contact hello@noyu.health.
The NOYU app is free, so there is nothing to cancel to stop using it - you can simply delete your account at any time. The following applies if you buy a blood test.
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have 14 days from your purchase to cancel a blood test for a full refund.
If you book a blood draw or redeem your test within the 14-day period, you are expressly requesting that we begin providing the service immediately, and you acknowledge that your right to cancel is lost to the extent the service has been supplied - we cannot un-book the clinic slot or un-ship the sample kit. In practice, booking a draw ends your automatic refund right, though we may still offer a partial refund on request.
Approved refunds are processed to the original payment method within 10 business days. Nothing in this section affects your statutory rights as a consumer.
The Platform and its original content, features, and functionality are owned by PROJECT 120 LTD and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Platform for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the Platform without our express written permission.
When you upload, log, or connect data to the Platform (including Health Data, questionnaire responses, food logs, journal entries, and wearable feeds), you retain ownership of that content.
You grant us a worldwide, royalty-free licence to use, store, and process your content for the purpose of providing the Services and, in aggregated or anonymised form, to improve them.
We do not sell or rent your data, we do not use your Health Data for advertising, and we do not use your identifiable Health Data to train AI models - ours or anyone else's. This is set out in full in our Privacy Policy.
The Platform integrates with Third-Party Providers such as laboratories, wearable devices, and health apps. We are not responsible for the availability, accuracy, or content of third-party services. Your use of third-party services is at your own risk and subject to their own terms and conditions.
This section applies when you download or use our iOS app from the Apple App Store. You and we acknowledge that these Terms are between you and PROJECT 120 LTD only, and not with Apple Inc. ("Apple"), and that Apple is not responsible for the app or its content.
Your use of the Services is governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. Please review it carefully.
We may suspend or terminate your account and access to the Services if you breach these Terms, fail to pay applicable fees, or engage in behaviour that compromises safety or the lawful operation of the Platform. Upon termination, your right to use the Services will cease. You may retain read-only access to your historic data for a reasonable period, after which it may be deleted.
The Services are provided "as is" and "as available" without warranty of any kind. While we use reasonable skill and care, we do not guarantee that the Platform will be uninterrupted or error-free.
To the maximum extent permitted by law, PROJECT 120 LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Services.
To the maximum extent permitted by law, our total liability to you for any claim arising out of or in connection with the Services is limited to the greater of the total fees you have paid us in the twelve months preceding the claim, or GBP 100. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded or limited by law.
You agree to indemnify and hold harmless PROJECT 120 LTD and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Platform, or content you upload that infringes the rights of others.
We shall not be liable for any delay or failure to perform our obligations if such delay or failure results from circumstances beyond our reasonable control, including natural disasters, war, terrorism, strikes, government action, power outages, or failure of third-party services.
We are committed to making the Platform accessible to all Members, including those with disabilities. We aim to meet WCAG 2.1 AA standards. If you experience any difficulty using the Platform, please contact us at hello@noyu.health so we can assist and address any accessibility barriers.
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales. If you reside elsewhere in the United Kingdom or in the European Economic Area, you may also bring proceedings in the courts of your habitual residence. Nothing in these Terms affects your statutory rights as a consumer.
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Platform at least 30 days before the changes take effect. Your continued use of the Services after that date means you accept the updated Terms.
